FOCUS NOW TRAINING — TERMS & CONDITIONS

Welcome to the Focus Now Training website (the "Site"). By accessing or using our services, you agree to comply with and be bound by the following Terms & Conditions. Please read them carefully. If you do not agree, you may not use our Site or services.

1. Overview

Focus Now Training ("Company," "we," "us," or "our") specializes in corporate training, executive coaching, and organizational performance programs designed to improve attention, focus, mindfulness, and cognitive fitness in the workplace. These Terms govern your use of our Site, services, training materials, and all related content.​

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. By accessing the Site, you agree not to:​

3. Intellectual Property

All materials created by Focus Now Training — including but not limited to training curricula, workshop content, guided meditations, compassion tools, breathwork protocols, slide decks, frameworks, templates, videos, and written content — are the exclusive intellectual property of Focus Now Training.​

Clients are granted a limited, non-exclusive, non-transferable license to use these materials solely for their internal organizational purposes during the term of their engagement with us.

Reproducing, reselling, redistributing, sublicensing, or modifying our materials for any commercial purpose is strictly prohibited without prior written consent from Focus Now Training.

Upon termination of services, the client's license to use Focus Now Training's proprietary materials is immediately revoked.

4. Services and Payment

Focus Now Training offers in-person workshops, hybrid training programs, virtual training sessions, coaching, and retreats.​

Specific pricing, payment schedules, and deliverables will be outlined in individual service agreements, proposals, or invoices provided prior to engagement.

Payment is due in accordance with the terms stated in your service agreement. Late payments may result in the suspension or cancellation of scheduled services.

Returned checks, declined payments, or disputed charges may incur additional administrative fees.

Refunds are only available as explicitly outlined in the applicable service agreement.

5. Cancellations and Rescheduling

Cancellations or rescheduling requests for workshops or sessions must be submitted in writing at least 5 business days in advance.

Cancellations made with less than 5 business days' notice may be subject to a cancellation fee as outlined in your service agreement.

Focus Now Training reserves the right to reschedule sessions due to unforeseen circumstances and will make reasonable efforts to notify clients promptly.

6. Results Disclaimer

Focus Now Training provides education, coaching, and training programs based on evidence-informed practices in mindfulness, breathwork, meditation, and cognitive performance. While our programs are designed to support measurable improvements in focus, resilience, and team performance:​

Individual and organizational results may vary.

We do not guarantee specific outcomes, productivity gains, or performance benchmarks.

Client results depend on factors outside our control, including participant engagement, organizational culture, and consistent practice.

7. Confidentiality

Focus Now Training will treat all proprietary business information shared by the client as confidential and will not disclose it to third parties without written consent.

Clients agree to keep the proprietary content, frameworks, and methodologies of Focus Now Training confidential and not share them externally without written permission.

8. Disclaimer of Warranties

The Site and all services are provided "as is" and "as available," without warranties of any kind, express or implied. Focus Now Training disclaims all warranties, including but not limited to:​

Merchantability

Fitness for a particular purpose

Non-infringement

We do not warrant that the Site or services will be uninterrupted, error-free, or free of technical issues.

9. Limitation of Liability

Focus Now Training shall not be liable for any indirect, incidental, special, or consequential damages arising from:​

Your use of or inability to use our Site or services

Reliance on any content, advice, or recommendations provided

Actions of third parties connected to service delivery

Our total liability for direct damages is limited to the total fees paid for services in the preceding 12 months from the date of the claim.

10. Privacy

Your privacy matters to us. We collect and use data in accordance with our Privacy Policy, which is incorporated by reference into these Terms. By using our Site, you consent to the collection and use of information as described in our Privacy Policy. We do not sell your personal information to third parties.​

12. Testimonials and Case Studies

By providing a testimonial, review, or agreeing to participate in a case study, you grant Focus Now Training a non-exclusive, royalty-free license to use your name, company name, and statements in our marketing materials, website, and social media, unless you have specified otherwise in writing.

13. Termination

Focus Now Training reserves the right to suspend or terminate access to our services or Site if a client violates these Terms, engages in unlawful activity, or behaves in a manner harmful to Focus Now Training, staff, or other clients. Termination does not relieve the client of any outstanding payment obligations.​

14. Governing Law

These Terms and any disputes arising from your use of our Site or services shall be governed by the laws of the State of New York, USA, without regard to conflict of law principles. Any legal proceedings shall be conducted in the appropriate courts of New York.​

15. Modifications

Focus Now Training reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Site or services following any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.​
